These Terms & Conditions govern access to and use of the FANTASTICO platform, operated by Byte42 S.r.l. By registering, you confirm you have read and accepted them.
1. Purpose of the service
FANTASTICO is a platform that provides subscription software vendors ("Customer") with access to AI models and related services, with centralized management of credits, budgets and access keys.
2. Who can register
Registration is reserved for entities acting in the course of a business, professional activity, or otherwise holding a valid VAT number. Registration by private consumers is not permitted.
The Customer warrants that the information provided at registration, including the VAT number, is truthful and up to date.
3. Account and credentials
The Customer is responsible for safeguarding its login credentials and any key issued through the platform. Byte42 is not liable for misuse resulting from the Customer's loss or disclosure of such credentials.
4. Credits and AI usage
The Customer purchases or is granted, as part of a subscription, a usage budget denominated in currency for access to the AI models available through the platform. Usage exceeding the included budget is billed separately according to the subscribed plan.
Unused included budget does not carry over to the following period unless otherwise agreed in writing.
5. Limitation of liability
Byte42 provides the platform "as is" and does not guarantee uninterrupted availability. To the extent permitted by law, Byte42 is not liable for indirect damages arising from use of the platform or of content generated through the AI models.
6. Suspension and termination
Byte42 may suspend access in the event of use that does not comply with these Terms or of non-payment. The Customer may terminate at any time; unused credits are not refundable unless otherwise agreed in writing.
7. Changes to these Terms
Byte42 may update these Terms. Material changes will be communicated with reasonable notice before taking effect.
8. Governing law and jurisdiction
These Terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the court where Byte42 S.r.l. is registered, subject to any mandatory applicable rules.
